High Court okays Kadoma Agricultural Show

The Kadoma Business Association filed an urgent chamber application seeking an order compelling Kas to allow the holding of the exhibition running from yesterday to August 13.

BY DESMOND CHINGARANDE THE High Court on Wednesday overturned a decision by the Kadoma Agricultural Show Society (Kas) to cancel this year’s exhibition.

The Kadoma Business Association filed an urgent chamber application seeking an order compelling Kas to allow the holding of the exhibition running from yesterday to August 13.

Justice Neville Wamambo granted the application.

The association cited Kas and Christopher Dirawo who represents the society as the respondents.

“Terms of order made that you show cause to this Honourable Court why a final order should not be made in the following terms: The provisional order is hereby confirmed as final and that the first respondent to pay costs of this suit,” Justice Wamambo ruled.

In its application, it submitted that on July 15 this year, the business community members concluded exhibition contracts with Kas, and the terms of the exhibition contracts were signed.

Kas later announced the intention to cancel the exhibition, forcing the association to approach the courts.

“That decision was reached without consulting applicant’s members and despite efforts to compel the first respondent to comply with the exhibition contract it still wants to cancel the agricultural show,” it submitted.

“There are no compelling reasons which warrant that the show be cancelled and that they will not be in a position to compensate applicant’s members for any loss which may arise as a result of the cancellation of the show.

“Applicant’s members have already parted with huge amounts of money to book musicians who are supposed to perform at the show and they have also parted with huge amounts in trying to stock goods for resale at the show.”
